Durable Slate gave me an estimate to repair my slate roof. The estimate included three basic repairs, to replace broken/damaged slate, replace chimney flashings, and replace ridges and paint. The salesman also offered a ten year warranty on the entire roof if I did all three items at the same time. I said I may be selling the house in the near future, he stated the warranty is transferable and would be a good selling point.

After considering the offer, I called Durable Slate and accepted their offer. The salesman returned and had me sign the contract. He did not leave a copy, I assumed I was dealing with a reputable company and was not concerned.

When the job was complete, in fact before the workers had even left the job, another person (quality control?) arrived with an invoice. I noted the invoice stated 10 year warranty on metal work. I protested that the salesman offered a 10 year warranty on the entire roof.

Over the next few months, the roof leaked when it rained. I called Durable Slate, who attempted to repair the leaks one time. The next rain it leaked in the same place. The leaks were where in an attic, where it was quite obvious. 80% of the roof is covered below with plaster and insulation, therefore unaccessible. After four months leaks became very apparent through the plastered areas. Durable Slate agreed the roof was leaking, but refused to repair until they were paid in full. Since that time, much mold and plaster damage has occurred.

Durable Slate proceeded to file suit against me in Municipal court. I tried to complain to the Better Business Bureau, but they said since Durable Slate had taken the matter to court, they could not intervene UNLESS Durable Slate agreed. (Durable Slate is a BBB Member) Durable Slate refused to mediate through BBB.

Out of concern for my credit rating, I spoke with an attorney. He advised I pay Durable Slate $9182.00, and felt that should take care of everything. I paid Durable Slate the amount $9182.00. A month later Durable Slate sent me a 5 page settlement agreement and Mutual release.in it is much legalese that basically says Durable Slate owes me nothing, and I owe durable Slate nothing.

Fact is, the roof did not leak before Durable Slate did their work. Since Durable Slate worked on the roof, it has leaked in numerous locations. I have paid them $9182, and they want me to sign a statement they owe me nothing. They refuse to mediate through BBB, although they are a paying member.

All I can say is, CAVEAT EMPTOR!!
