Mark McCracken, Crate Furniture.com Immediately withdrew money, delivered no product Petersberg, VA Petersberg Virginia

We ordered new cushions for our Cargo sofa and side chair from Home Spun and the money was immediately debited from our account July 20 to the tune of $616.94. The delivery date came and went until they called and said that they were having fabric difficulties (fabric company went out of business)."Patty" asked us to go the web site, choose another fabric and we would be at the top of the list for delivery October 23. They also promised free pillows for our patience.

October 22 I called to check on our order. Their e-mail address mysteriously disappeared from their web site so contact is now limited to Fax and phone. From this point on we did not talk to a real person and received rather prompt replies from an automated system addressing our concerns with the following:
"Your refund is being processed. Please check with your lending institution." (The intent appeared to be for us to get the credit card company to issue a refund and then let the credit card company duke it out with McCracken. Unfortunately we used a Visa Check Card and no refund can be issued after 60 days - which is about how long Home Spun strung us along.)

Since then it has been a never ending ritual of calling and leaving a message, FAX'ing a letter of complaint daily and not hearing back and not receiving a refund. Probably won't see our money again, McCracken is probably filing for bankruptcy as we speak or moving to another state to do business. We have reported McCracken and his company to the Virginia Consumer Affairs. Whether that results in anything is highly doubtful.

I wonder how he sleeps at night and whether his neighbors and family and friends know that he steals and scams people for a living? We are interested in joining any class-action suit or if someone can recommend a good lawyer, we'll contact them.
