On 10/19/07 I received communication from the property owner. I have been requested to update my prior report by today, 10/27/07 or civil action wil proceed with request for damages. However, the owner did not state what would fulfill her satisfaction not to proceed with legal action.

All I can say to update my report is the truth and what I and my guests experienced during our stay. I have attempted to resolve my dispute with this property owner but there was no desire to negotiate on her part. I offer the following comments concerning my initial report:

1. As of today, the website still advertises weekly rates of $2,300 even though I was charged (and later agreed to) a fee of $2,500. Thre is no mention that the July 4th holiday is a different price. There is mention: "until confirmed, rates are subject to change without notice". May I suggest the owner just advertise the rates she desires to charge.

2. We rented the property because of the pool feature. We were disapponted with the condition of the pool. The property owner herself has stated " The pool is getting a lot of use, much more than when I lived in the home. It is scheduled to be drained and resurfaced before the next summer season. My regular maintenance man had been working elsewhere for a few months, and his replacement was not doing a good job keeping the pool clear of debris. When I checked with you later that afternoon, you reported that all was well. I appreciate your report on this, and we have taken steps to improve this until the resurfacing can be done."

3. No explanation needed on this one. A walk through should be requested and a part of the contract to avoid any disputes.

4. The owner does live in a different state. When we arrived we were not able to enter the home. Serveral calls were made to the property manager when we had arrived to get keys since they were not left for us. We sat outside in the van with 2 children and 2 dogs it was over 90 degrees. Also, we had to call to request a mop and paper towels to clean prior to our departure.

I want to resolve this situation and focus on positive things in life. If the owner wants to resolve this, I am agreeable. I request a check for $10 for which we were charged for not cleaning the BBQ. The BBQ was cleaned and my sister could swear to this on a bible in the court of law. I would also ask the owner to thank us for treating her property with respect, being quiet tenants and for cleaning upon our departure.
