Built Constructed a Moldy Townhouse

This is the letter I sent to Knisley Construction regarding my new townhome which is moldy and they have continued to ignor me. These are not nice people. Beware!

This letter is being sent to you to document the continuing problems I have been experiencing with mold in my townhouse, located at 931 Golden Way, Street, Isanti, MN, 55040. This townhouse was built in 2005 and I purchased it October 31. The mold growth in the walls and the attic is very severe for a new townhouse.

I notified you in the middle of July, sent pictures of the mold growth in my residence, but I have yet to see any attempts from you to assist in identification, treatment, and resolution of this issue. I was told by you that at first the mold was bugs, then I was told it was mold at the August 29th meeting and to use bleach. You had asked me what do you want us to do about it like it was not your problem. I also was informed by you that mold was not a warranty issue.

I paid for an on-site inspection by a reputable environmental company specializing in mold issues. Not only did this inspection require me to pay $500 out of my own pocket but also required me to miss work. The inspection itself found mold permeating the entire substructure of my residence, and has detailed the poor construction and moisture issues which have led to my current predicament.

To summarize, the property I had purchased from you in good faith is not worth even a fraction of what I paid for it. It cannot be resold without disclosing the mold issues, and that is assuming that proper treatment actually solves the problem. I have ongoing health issues, including severe allergies to mold and fungus (I have been tested). These medical issues have become more severe since I have purchased my townhouse. The resolution I am now seeking is a total repurchase of my property by your company. I want my initial purchase price, including closing costs refunded, and repayment for the home inspection.

At this time, I am working with the State Attorney General's Office to file a formal complaint and ask for mediation and resolution. As a secondary action, I have spoken with a lawyer specializing in these types of issues. My first step is to, once again, notify you that I demand prompt attention to this serious problem. I expect to hear from you no later than October 15. If this date is not met, I will be forced to retain the services of an attorney and move forward with litigation.

I believe it would be in both of our interests to resolve this issue in a timely manner. I look forward to your prompt attention regarding this very serious matter which has health and safety ramifications.
