Avery advertises every day on the radio in Dallas about their summer special reduced rates on air conditioning. During this summer special they advertise that you get 3 free windows with each air conditioning system you purchase. These windows are not specified as any particular maximum size, style or dimension. On the salesman's calculations, he applied the purchase discounts they were advertising for their summer special to each of the air conditioning systems to come up with a calculation of $20 thous and calculated $10k for windows which included the ones that we were getting for free plus purchasing. He said if we didn't make him come out a second time to make the deal he'd do it for $30,000. I agreed to purchase two air conditioning systems, 16 windows, plus entry and den windows for $30,000 and signed a purchase contract for that.

Based on an offer of 12 months, no interest, no payment financing filled out a credit application. I didn't get a copy of the credit application and wasn't sure what lender it was with.in early Aug. 2007 they installed my air conditioners and although they were supposed to come to measure my windows for replacement they never showed up.

After they finished the air conditioning installation they handed me a stack of documents to sign for the financing. The stack of documents was with American General (AIG). I questioned the fact that the documents said that the consumer shouldn't sign until all the work was performed and they said that I had to sign them so that they could get paid for their air conditioning. While I was hesitant about it I kept thinking that since Honesty above reproach was their motto, I shouldn't worry about it.

In the documents were notices of my three day cancellation right for the financing, all of which were dated on 7/31 indicated cancellation rights expiring on 8/3 and weren't presented to me until 8/4. All of these indicated that I had applied for financing with American General on 7/31, which I had never done. When I asked for later on and received copies of the credit applications, the one that I filled out on 7/31 was with Wells Fargo and there is a resulting inquiry to my credit as a result of that application.

Unbeknownst to me, someone at Avery took my information, transferred it to an American General credit application and filed for credit with them, in my name, on 8/1 which shows as an inquiry on my credit report on that day.

When the person came to measure my windows, I asked for a quote to replace another few windows. Then over a week went by and I didn't hear anything at all. I called the sales rep to ask where my windows were because they were supposed to be installed within a week of the windows being measured and not only weren't they installed no one had even called to schedule an appointment for installation.

The sales rep said that they were waiting to hear from me, which was news to me, to find out if I planned to do the whole house or just the windows that I ordered. I asked for them to send me the quote for the additional windows that I'd asked for. What I received was a quote for all of these windows costing over $55,000, however more shocking was that for the list of the windows that I had supposedly already purchased they were now telling me that I had to pay another $30K to get them installed.

While up until now I understood I was getting over 15 windows plus my entry windows for $10,000, (6 of which were part of their free offer), now they were telling me that what, up until now, was categorized as one window was two, so that in essence I was buying 5 windows for $10,000 (since of the 8,3 were free. At about that time, two other things happened that really disturbed me.

Also we received a welcome letter from Wells Fargo along with a Home Improvements Visa card with a $17,500 line of credit issue in conjunction with my affiliated retailer. Then I received a bill from American General for a $30,000 debt, which showed my 12 months no interest, no payment financing and that Avery had been fully funded for work and products they have not delivered.

Avery had no legal right to submit funding applications to two lenders prior to my signature and my understanding they have violated Federal Truth in Lending Laws and state of Texas laws.

Avery would not make good on the deal, except with a laughable offer of a couple of thousand dollars for the over five seven thousand in free windows.
