Not responsive and will not correct issues with concrete job around pool ripoff

On 29 March I paid Christopher Brooks $5900.00 for pouring concrete around a new in-ground swimming pool. I paid for all the concrete and materials separately and the $5900.00 was for the labor charge (I later found out that he used illegal immigrants from Mexico to do the job).

After the first rain, issues with water draining into the pool were found. I immediately called Mr. Brooks (1st phone call) who told me that he would meet me at home and check out the problem. He never showed up and repeated phone calls and messages from me have resulted in no response from Mr. Brooks. I tried calling him with different phones, and those times that I did get him resulted in him hanging up on me and not talking with me to resolve the issue.

This has been going on for three weeks now. I called another concrete company in to check out the situation, and they confirmed that the concrete was not poured correctly and that the grades for the slopes were incorrect. The concrete would have to be cut out and new concrete poured at the correct grades. I now believe at this point, with the non-response and reactions from Mr. Brooks, that he has no intention of correcting the problem.

Some other items of interest:

The first time I called and got Chris, he indicated that he would come out and take care of the problems. He told me that the head of the crew (named Greg) which did the work was let go and no longer works for him. The last day of the job my wife and I provided the crew with lunch and I was told by Greg that Chris was using illegal immigrants from Mexico and paying them without withholding taxes. Greg did not like this as he had to pay taxes and they did not.

Also, in a last ditch effort, I got Chris on a Nextel phone on 16 Apr 07. He stated that I was harassing him by calling all the time and leaving messages. I again told him that we can settle this as gentleman from which he said that he was busy and would call me on my cell phone that night to discuss it. Again he never called which has generated this action.
