On January 3 we purchased the following pieces of Stanley Furniture from Granada Furniture Gallery:

The full purchase price was $5249.86. We gave their representative a $00 down payment on 3 January, and signed an installment agreement to pay the remaining $3249.86 over the next 12 months, payments to begin on 2 February. We were told then that the furniture would be delivered within 4 to 6 weeks by Bryan, their sales representative.

Granada Furniture essentially sold the retail installment contract to Equity One Finance, and we were to pay the balance of $3249.86 to Equity One Finance in installments beginning 2 February.in good faith we have already made payments in the amount of $543 to Equity One.

On or about February 20, I became concerned because we had heard absolutely nothing from Granada Furniture company about our furniture, and over 6 weeks had passed. I called Stanley Furniture to inquire if Granada had even ordered the furniture, and Stanley representatives assured me that Granada Gallery Corporation had not been an authorized Stanley retailer since well before we signed our agreement to purchase Stanley furniture with them.

I contacted Equity One to inform them of this situation, and that I was very concerned that we would not receive any furniture. I also contacted Rick Iannaci (owner of Granada Furniture Gallery) on or about February 26 and told him what I had learned. He assured me that he had ordered the furniture from another retailer and that it was on its way.

A couple days later Ianacci contacted me and told me the furniture was ready for delivery Friday, 2 March. On March 2 Granada employees delivered only the desk to me. I contacted Ianacci and he assured me the rest of the furniture would be delivered Saturday 10 March at 4:00 PM. The furniture did not come.instead we got a message from Ianacci stating that he could not locate the furnitureKthat it was in transit somewhere.

I was unable to reach Ianacci by phone, as nobody answered the Granada Furniture Gallery business phone the numerous times I tried to reach Ianacci. I left multiple messages, and received no return call. I therefore had to go to Granada Furniture Gallery and confront Ianacci in person Thursday, 15 March. At that time he informed me you still had no idea where the rest of the furniture was.

My wife and I spoke to Ianacci in person on the following Saturday 17 of March, at which time he stated that he would sell us the desk for $870.00 and refund our $2000.00 down payment by crediting the debit card number we used to pay it with. He also stated that he would contact Equity One and work something out with them such that he would be paid the $870. Oo plus tax and delivery, and he would refund the rest to Equity One.in other words we would be refunded everything except the money we agreed to pay for the desk, and have no further obligation to Equity One.

I contact Equity One the following Monday or Tuesday, and informed them of our conversation at which time their manager, Elaine, stated that Equity One could not accept payment from Granada Furniture, that Granada would have to refund us, and we would pay Equity One the full amount of the loan. According to Equity One, Granada Furniture Gallery owes my wife and I $2267.00 in addition to our $2000.00 down payment, for a total of $4267.00.

My wife and I spoke to Ianacci in person again on 24 March, at which time he clearly stated to us that he was going to credit our checking account for $2000 and had already cut a check for the remainder and it was already in the mail.By Sunday, 1 April, there had been no credit to my checking account (as promised), and no check in the mail (as promised). It is clear that Mr. Ianacci purposely deceived us, and lied to us, probably all along.
