I signed a contract with BuyOwner, after having a salesman meet at my home late at night and explaining everything over three or so hours. There is small box on the contract with says that they have no refund policy, however there is also a separate contract which states you have three days to cancel. I was told by the sales rep that I could cancel with in three days and that the NO REFUND policy applies after such time.

Once I realized that they actually had me a sign a piece of paper which put a lean against my home, I decided I would send in my cancellation (which was that same night). I went to the office the next morning and turned in my cancellation, having it signed by the manager on duty, Sean Forha.

BuyOwner should have refunded me for the following reasons:

I signed the contract the night of March 9th, and turned in the cancellation the morning of March 10th, the ad should have never been posted.

The ad that was posted was done so with preliminary pictures taken by the salesperson that night. I never had any professional pictures taken nor did I get a 360 degree tour shot which was supposed to be what their fees are for. The ad was also posted against my will after submitting the cancellation.

BuyOwner eventually sent me back my original contract stamped "cancelled" (which I have and so does Bank of America).

I also mailed a letter to confirm cancellation (as I never heard from the owners as manager Sean Forha promised) on March 21 reminding them that I had cancelled and that I had handed my cancellation letter directly to Sean Forha. Additionally I asked them to please notify all their affiliates that I have cancelled. As their affiliated Real Estate company MLS Realty began soliciting me, via my cell phone, repeatedly.

I never received any other response other than their salesperson calling me back to act like my friend and talk me back in to it. The owners, nor any other official, manager or director ever called me to speak about my refund. They currently are keeping my $2250.00 for which I received nothing but their sales materials and headaches!

Besides the fact that their contract, which consists of several separate documents is misleading, their salespeople lie, they are also in violation of the Federal Truth Lending Disclosure and Simplification and Reform Act of 1980 which states there is a three day rescission period for any contract. I have all documentation and certified letters needed, and I am more than willing to pursue legal action or answer any questions for fellow consumers.
