Ripoff Unfair Trade Practice on Painting of Home

On June 28, I hired Souza Painting to paint my house. I was given a contract prior to the job commencing however, it was never signed by me or any affiliates of Souza Painting.

The contract stated that they would pressure-wash the house, hand scrape, prime & paint. The house was never pressure-washed, scraped & if it was at all primed, it was not only very little, but I believe it was primed with interior primer, as the can with the remaining primer indicated that.

I gave a deposit of $60.00. The total cost for the job was supposed to be $3400.00. I inquired to Mr. Souza that I'd also like an estimate to have him repair my front, brick steps repaired when the painting was complete. Although I never got that estimate, I sent Mr. Souza a check for $3500.00 before he even began the painting.$3400.00 was for the house painting &
$100.00 was a deposit for him to begin the repair
of the steps.

Within 2-3 days after the painting was completed, I noticed bubbling in the paint all over the house, cracking in the wood clap-boards and paint chips falling off. I notified Mr. Souza of these problems and he promised to repair any problems. After that, I called him several times to set up a time that was convenient for
him to do the neccessary repairs. I kept getting his voice mail & left messages for him to contact me, yet he never did. I finally reached him by phone & he said he would be over the next day, July13 @ 8:00am. He never showed up & never returned any of my calls.

I have talked to a couple of attorneys regarding this & was told that I may be able to sue this company for triple damages if they did not respond to a 30day letter
of demand.

The problem is that I am on a very tight, fixed income (SSDI) and can't afford the attorney fees, which are $1500.00-$2000.00 up front. I want to know if there is any advice for me to regain the $3560.00 I've given to this company, plus money for damages such as emotional stress, seeking legal help, reporting to BBB & Consumer Affairs, which incidently claimed they could'nt help me.
