Oil change done with transmission fluid rather than motor oil

Had my car serviced for an oil change at NTB in Sachse, TX in August. My car started running rough and shutting off. After several mechanics trying to find the problem, one found transmission fluid in the engine and they broke the bolt to the oil pan. They said they will reimburse be for the $320 (which I don't have) but they have refused my claim, saying that there is no way they would have used the incorrect fluid. I have pictures from the mechanic but no sample. My car is still running rough, their 3rd party inspector and the mechanic agree the ventilation system is clogged. Not to mention what else may be wrong. I need a diagnostic done at their expense to determine any other issues and repairs needed.
