I attempted to purchase a vehicle in January from Walker Automotive. Everyone who has ever heard of them knows the slogan " when everyone else says no, walker says yes." If I would have known then what I know now, I would have taken my business elsewhere.
I am a divorced, disable veteran, mother of 3. I took my business to Walker Automotive. The atmosphere was welcoming, all smiles perfectly placed. Whenever I couldn't come up with the full amount of the down payment M. Burks and myself came up with a promissary to pay on the remaining balance owed towards the vehicle. My only instruction was "what ever you do, DO NOT tell the finance company about this side deal." I thought that this was the luckiest day of my life. A few weeks later I became ill due to unknown etiology. I ended up having to resign from my current but was able to quickly obtain employment from another facility. Drive Financial allowed me to defer my February payment. Because of the hardship I was unable to pay the remaining balance of the promissary agreement and asked if new arrangements could be made. The answer was yes. I signed a notorized statement telling them exactly what dates they could debit my account. Things were fine until they found out that I'd been making my monthly payments to Drive Financial but hadn't paid them off their balance. Then the harassing phone calls started. They even went as far as calling a friend stationed overseas and my mother who suffers from a debilitating disorder.
Lawrence Searcy left horrific messages stating at one point he would report the vehicle stolen. Mr. Searcy even stated that he was going to sue me for the 400 dollar check payment that he himself refused because it wasn't in the form of a cashiers check. This was in the later part of February. At this point I phoned Drive Financial and asked what was going on with my account. I told them about the messages and was informed that they were not aware of any problems with the loan and that arrangement were made to defer the Feb payment. The invoice for March came in, I made my payment. The calls started again. Mr. Searcy stated that "they" were the lien holders on the vehicle. I told him that legally there cannot be 2 lien holders. Drive Financial was accepting my payments and they weren't aware of any problems. I reiterated the fact that I agreed to have the balance owed to them paid in a timely manner. He stated that the promissary agreement that I had notarized wasn't legitimit enough. And that he would tell the authorities that the tags were illegally obtained.
The threats got more and more menacing. It wasn't until I went to make my April payment that things finally came to a head. I called drive financial, as usual the customer service representive greeted me and asked if I would be making a payment. I told her yes, but first I needed to talk to the indiviual handling my account. I was transfered to an individual named Sal. I asked him if he were aware of any problems going on with my account he immediately said no and then asked me to hold. When he came back he told me that it had been brought to their attention that a side deal had been made at the time of purchase. He also stated that the agreement with all of the dealship they deal with states that two thousand dollars must be put down - no acceptions! He stated that if they'd known that a side deal was made they would not have approved the loan. He apologized.
The vehicle was surrendered May 6th. The paperwork that was submitted to the judge in regards to the seizure of the automobile (the bill of sell, etc.) were completely different from the paperwork that had been given to me. The price, the down payment etc. It was also brought to my attention ther the money paid to drive financial was sent back to Walker Automotive in the form of a check in both my name and Walker Automotive. Meaning that they recieved more than the required down payment.including an 836 dollar payment that was made January 24 that miraculously dissappear by was signed as recieved by C. Gaspard.
Encounters like this one make it "very" hard to trust individual. They made an attempt to fraudelently obtain funds from a finance company and I ended up loosing lots of money and at the time my means of transportation. I'm a firm believer that God doesn't sleep. And if nothing else I hope that Walker Automotive will be exposed for the crooks that the are. They screwed up and tried to discredit me with legal jargon.
