Fraudulent Insurance claims after harassing repo experience

Dealing with Wachovia Dealer Services or whoever they are calling themselves this week has been a nightmare for our family. My husband is a contractor and we purchased several vehicles from the same dealership when he was working and things were going great for us. We even brought my brother and mother down to purchase vehicles over the years and we paid several of them off.

Two years ago my husband came down with gout and we began to struggle financially. We did everything we could to keep our vehicles and to make things work by working with this company to make alternate payment arrangements. We eventually lost our home and were really struggling to keep things afloat and they started getting very nasty with us. My brother sufferred a back injury and lost his job. My mom went through a divorce after the loss of our home and is now on forced social security and works only part-time due to her age and social security restrictions.

To make a long story short we lost our personal vehicle to repossession and then my brother lost his. Both times Wachovia sent a repo guy to our home on both occassions and took the vehicles. Unknowingly to us they then filed false claims with our insurance company stating the vehicles were damaged while in OUR posession. Luckily, the insurance company investigated their fraudulent claims and refused to pay them. The damage wasn't consistent with their claims, but more consistent with happening while being put on or off a tow truck. This was two seperate incidents and two seperate insurance claims with different companies.

I believe their latest scam is to pick your vehicle up and then damage it, (ours were large trucks or suvs and they can no longer sell them for what they want now) in order to recoup their money. Then they file a fraudulent claim against you with your insurance company and your insurance company wants you to pay a deductible for the repairs! They scrap the vehicle and collect a check from your insurance company worth more than you owed them to begin with. Nice scam huh?

Consumers beware!

Make sure you take a recent photo of your vehicle at all angles and use a digital camera with date or make a video of the actual repossession. Ask the repo guy to wait as you take these photos. NOT having these photos could cost you a ton!

Also know that this company is constantly adding extra fees and charges to your account. Even if you've just paid them they tell you that your account is behind and they will charge you new late fees. You are NEVER able to get your account up to date with them. They say one thing and they do another.

They will threaten you. Abuse you verbally, call you 20-20 times per day and talk down to you about your financial status. They demand payment "TODAY" over and over and threaten you they are sending a repo man for the vehicle. They get angry at you if you are not intimidated by their nasty collection practices.

I admit and take responsibility for the fact that we fell into a time of financial difficulty. This was not by choice, nor was it on purpose. Obviously we wanted to keep all of our vehicles and we had a lot of money invested in them. The problem is, when you do not have the money to meet your financial obligations you can not create money out of thin air! If I could have done that I would have done that believe me.

I am simply trying to warn others now that the harrassing phone calls and nasty people that work at WFS/Wachovia are also out and out fraudulent and will do everything including filing a fraudulent insurance claim against you to collect their money. Please take photos, record conversations and do as much correspondence with this company as possible in writing.
