I purchased a mini moto 50 cc dirt bike and it came late and won't run

On Dec 12 I located Legion Global on the web. I called and placed an order for a 50cc mini moto dirt bike and an American Flag Helmet. I paid $70.00 for express shipping and they took the money out of my account on Dec 13. The bike never showed and after several attempts to contact Legion Global they gave us an invalid DHL tracking #. We called several times being told that we talking to Mark, Jay, Ryan and John, but the person always sounded the same. We finally got to whom was the manager and his name was Gary, but he sounded the same as all the rest. Can you scam? I then contacted the local police dept to make a report. We had them on the phone curing at us when she arrived. She got on the phone and spoke to them. They ten said it would be shipped and be here in 2 days. The shipped it alright without the helmet, with a broken seat and it won't start. This was my 6 years old's Chritmas present. It also came another day later then they said it would. I have since went to the bank to the dispute the charge, but they can't help because it was shipped. So, I am on my way to Court. We have made several attempts to contact them about the parts again I get Mark and John whom sound the same. We were promised them on Wed, still not here. I just called again and Mark said he can't help me and no one else is there. ALthough he managed to give me another invaled DHL tracking #. I wouldn't trust them with anything if you consider a purchase. Please be alert when purchasing from this company as they are SCAM!!
