Purchased a transmission in which they failed to send and gave my entire company a run around for three weeks, they have kept monies and failed to comply. They will not issue refund or answer calls. They have not kept their portion of a contract

I am a shop owner in Tennessee I currently purchased a transmission from Asap Motors in which it was never received, shipped or placed. This company has failed to comply with us in all terms.
On 12/13/06 they were suppose to shipp a transmission to us never went out according to several of the company employees. They kept giving me the run around for 3 days causing my small buisness to have conflicts with our clients because of this.
I spoke to shipping manager and sales agent they gave promises and did not keep on Thursday they stated that the part had been picked up by the carrier.
I called the carrier to verify and came to be that they lied all the time and no part was ever sent out.
I then spoke to two managers and they stated to return monies that day and no monies were retured. We have been pushed around for over 3 weeks now they have kept our monies and are not returning to us.
I have spoke to every personnel, emailed called their merchant and we have not received any feed back.
General manager of this company as I was told is Dina, shipping manager is Marques and sales agent is Gayvon I believe.
At the moment am seeking legal action and contact the board of buisness commision also contacted my credit card for fraud.
Am afraid of this company and the damage it can cause us.
