Superstition Ford - Alarm system addon over advertised price/financial shenanigans RIPOFF

To whom it may concern:

On friday afternoon august 26 my husband went into earnhardt ford (superstition) and bought a car. He alone signed all papers. (this was after they took his keys and refused to give them back and other methods of undue coercion and high pressure.) paul is 75 and we have been married 50 yrs.

I was upset, of course that he made such a monumental decision without my approval but the main obstacle to a valid contract was the addition to the advertised price in the mesa tribune of an alarm system which earnhardt supposedly installed. I called justin immediately (five minutes after paul arrived home with the car!) upon scanning the contract and asked them to please remove the system as we neither needed it nor wanted it. The car was advertised that very day in tribune for exact price he paid but it did not mention any additional alarm system costs!!! I have the ad. He refused. I then offered to return the car and we would look elsewhere. He said i would be arrested if i came on the lot to do same. The car purchased is a nice car and i gave up, taking lesser of two evils. A stroke for either of us old folks or acceptance.

I resigned to the car purchase and even the alarm system (although i see no use to it for us. This is a dealer advantage! If we can obtain paperwork?) since my husband did signand he is of his right mind, although a little hazy on making judgement calls. His father passed away at 76 due to stroke related problems. I am trying to maintain his integrity here, also.

I called earnhardt dealership monday morning on august 29th and informed them we would be bringing in our own financing and to disregard theirs (since theirs entailed 75 months of payments and no down payment!) we should live so long, literally! Jim schuffer said ok. I also have copy of email sent to them stating just that. We took in down payment check from savings and told them we would be in saturday with remainder as we had prior commitment out of town. They accepted our letter, cashed our check and in general agreed? (check was cashed wednesday?). On friday when we arrived home, a message from justin informed us the financing had already gone through and they would be refunding our down payment. I called him immediately and said we had the check for the remainder and would be in saturday. Jim refused the check saying the loan had gone through! Now, of course we can pay it off and redo but that will entail registration changes etc. I have tried repeatedly to obtain a loan number which they refuse to give us! Jim did tell us commerce bank has financing, but they have nothing in their files. Justin tells us we must use their financing! And jim says my hands are tied because he is in the middle. Now dishonesty is rampant here and i suspect justin is in the middle of that! I have signed nothing!!! Nor will i? Do not both husband and wife have to sign loan transactions in arizona? I called the bank they specified as having the loan and they deny having any such loan!!! I talked to matt at corporate financial (mr ed) and he says the loan shows finalized. Why can't we have the courtesy of a call back giving us a loan number then so we can undo it?

WE ALSO ASKED FOR VERIFICATION OF THE ALARM SYSTEM, INSTRUCTIONS AND DATE OF INSTALLATION. They refused. We have no paperwork on it other than their performance guarantee and a paper saying there is a deluxe security alarm system. That paper has boxes for acceptance or declination and neither is checked. Husband did sign both however. (see above high pressurethey said it might wreck the car taking them off?) WE OBTAINED NO DISCOUNT ON INSURANCE WITH ALLSTATE AS PROMISED IN THE CODE ALARM STATEMENT!

I am forming a group of ex customers for earnhardt ford (superstition) to pursue possible litigation as to their business practices and methods.

On advice of an attorney, we asked for copies of alarm system specs and all copies of financial paperwork released to us since we obtained our own financing. Jim refused to give us those papers as justin evidently has ordered him not to?

Since this is a holiday weekend, we will wait until tuesday to pursue this matter.
We are determined to put these scoundrels in their place, however. We are two retired people trying to get along and cannot afford to spend pension on attorneys, but will find help.

All we ask is truth and honesty.
1. copies of alarm system specs, operating instructions, date of installation.
2. a loan number so that we may check on truth of justin's statements? I suspect there is commission/kickback involved here on his part and he is barnstorming for only that reason? Certainly he is not interested in integrity and honest customer service!
Are we being unreasonable?
