On April 3, 2025, I purchased a used 2023 Nissan Ariya (VIN: JN1BF0BA8PM401833) from Car Vision Inc (Dealer License No. 07687U). The vehicle was explicitly marketed and advertised online at a net price of $19,999 "After IRS EV Tax Rebate". Please see the attached file "", which shows this original online ad.
During the purchasing process, the dealership generated a Vehicle Buyer's Order and a "Your Deal Breakdown" sheet charging a base selling price of $23,999.00. When I contested this and cited the advertised price of $19,999, the General Sales Manager, Mr. Keith Penny, stated that the dealership could apply for the rebate if I provided a Social Security Number (SSN) or tax number. When I informed him that I did not currently possess one, Mr. Penny explicitly assured me that it was "no problem" and that once I obtained an SSN later, I could apply independently to recover the $4,000 I was being forced to pay upfront above the advertised $19,999 price, confirming I could be refunded later.
I explicitly refused to accept any verbal commitments. To legally bind the dealership to this representation, I wrote the following provision directly onto the "Your Deal Breakdown" sheet: "This amount does not include the rebate, which the buyer will apply later." Mr. Penny then countersigned directly next to this text to officially confirm the terms. Furthermore, the official Bank of America Cashier's Check (No. 6311703205) delivered to and accepted by the dealer for the full balance of $25,005.00 carried a restrictive endorsement memo reiterating this exact condition: "THIS AMOUNT DOES NOT INCLUDE THE REBATE. THE BUYER WILL APPLY FOR REBATE". These executed records are all available in the attached file "Car Purchase Documents.pdf".
The dealership subsequently failed to process the transaction as an IRS "Point of Sale Transfer," which is the legally mandated federal mechanism required for a dealer to initiate so a buyer can receive the benefit of the credit. In subsequent written follow ups to resolve this breach, I provided the dealership with my business EIN, mistakenly identifying it as an ITIN in a typographical error on May 14, 2026. I have since issued a formal written correction to the dealership manager, Nestor Calderon, clarifying that the transaction was executed strictly in my individual capacity, as corroborated by the signed Buyer's Order.

On page 1, you will find my demand notice dated May 14, 2026. You will also find the dealership's formal refusal dated March 17, 2026, where management explicitly acknowledges the signed contract provision stating the purchase price excluded the rebate.
This administrative tax ID clarification does not alter the core substance of my complaint. By giving false and deceptive compliance advice to secure a sale falsely representing that an individual could "apply later" for a personal EV credit without the dealer portal step and subsequently refusing to adjust the transaction price when the federal credit could not be regulatory processed, the professional dealership knowingly utilized deceptive pricing. This consumer fraud and breach of contract has caused me an ascertainable financial loss of $4,000.00, which the dealership has refused multiple formal demands to cure.
