Arbys Dba ChiCo Fired for Injury on Job the business that doesnt give a dam Phoenix Arizona

I was working for Arbys in Phoenix (paradise valley mall) as an Assistant Manager/Manager in training. I was cutting a tomato one day and sliced the fleshy part of my left pinky off. I calmly walked in office and told the training Manager I needed to go to ER.

She took me and waited with me till she was called at the hospital by the district manager and told to get back to the store and leave me there. When I got seen I was told there was no saving the part that was cut the doctor then proceeded to cut the rest off that was hanging.

They told me I would need to be out of work for at least 2 days... At this point I then proceeded to call my training manager to let her know I would be out for two days but the schedule for the following week would be fine.

Mind you I was still in the emergency room at this point bleeding badly as they could not stop the bleeding and were wainting on a special medicine. My training manager then informed me that I dont have a job to come back to. I was stunned and horrified not only did I lose part of my finger but now I lost my job as well.

I was told I lost my job due to not following proper safety procedures... The problem was I was never trained in proper safety procedures and the day before I had cut up 15 tomatoes for the salads with my training manager right there next to me. She cut up lemons she was not wearing the safety glove either.

How can a company get away with this it is not proper nor is it right... I have pain in my finger now even though the skin is healed I cannot touch it straight down the nerves are to sensitive.

Workmans comp did not cover any pay due to their doctor saying I only had to be out of work for one week and you have a one week waiting period before any payment is made. I could not collect unemployment due to me not making enough in the quarter... So basically I got screwed and screwed bad.

The company is Chi-Co they are based Louisianna but they have stores in Chicago area, Colorado and Arizona and Albuquerque. The one I worked at was in Phoenix near the Paradise Valley Mall.

I hope that something can be done about this as now my family suffers as I am out of work and cannot provide for them and I am getting no help from the state nor from workmans comp. I contacted a lawyer but they have all said a battle up hill and I wont win.
