Fraudulent Credit reporting, messed up credit, unfair charges to account

In January on 2003 our payment was sent in on time to EMC Mortgage (mailed on the first), our following month was mailed on 2-1-03, the next payment was mailed on 3-1-03, then I planned on getting ahead and paid the April payment early around the 15th of March.

This is when I found out that the January payment was listed as not received. This then brought our account to current and upon further discussion I found out that they were also reporting it to the credit bureaus, I argued about this and they said that there was nothing that they could do. Also that they were not not required to inform me that it was late to begin with, but that they had called my house one time as a courtesy, although they never spoke to my wife or I.

Upon doing a refinance this did show up which caused some problems with loan availability. I disputed these marks on my credit and received a letter stating that the account was verified and lates deleted, although it is still reflected from EMC and I am having difficulty getting these removed from my credit report.
