Homecomings Financial
Unfair consumer practices in the mortgage industry

Business & Finance

I recently tried to refinance another property that we have and learned that Homecomings is reporting to all credit bureau's that we have 3 months or more of late payments which IS NOT TRUE AT ALL. I have the receipts from my mortgage payments to prove it too. So, I called their customer service number to speak with someone and to ask questions about my account. The moron I spoke to was absolutely clueless and talked completely in circles.

My first question was why they were reporting this account 3 mos. Or more late when I have made my payments on time every single month. Apparently in November the payment that was posted as the amount due on their website as wrong (which is the amount I paid) and was not a full mortgage payment so they put the total money paid that month in a suspense account. To make a long story short the suspense account was showing a credit in the amount of the payment I made that month. They never applied the amount of the payment to the mortgage. They took it upon themselve to leave it sit in this suspense account until the complete payment is made. I was NEVER notified that the payment for November was not a full payment and that they were leaving this money in a 'suspense account'. The moron I spoke to also told me that for every month after that (which is now going on 6 months since that payment) is considered late EVEN THOUGH I MADE A PAYMENT (regardless of the amount) THAT MONTH ON TIME.

I then reveiwed my account and it shows on March 31 that 3 late payments were charged to my account. Yes the same date with the same amount of late charges. I asked the representative about this and I got NO answer let me tell you. I then asked how to 'put my account in good standing' so that I can refinance this other property with a good credit standing. Now the 'normal' monthly mortgage payment is $1,079.64 and my payment in November was for $856.00 which leaves a difference of $223.64.

I made an extra payment in January of $100.00 which was not applied to the 'outstanding balance' and the rep. Could not tell me where the extra funds were applied to. Go figure.By the time I got a straight answer it would cost me over $300.00 to bring this account 'current' to their standards, even though I have made my payments on time every month since the beginning of the loan in May. Now I have to fight with these people to get my account straight so that I may get my credit report fixed and refinance my other property. Also, three months after they purchased the loan I received a letter from them stating that they raised our mortgage amount. That is COMPLETELY ILLEGAL.

I work for a law firm in cleveland, ohio and know this for a fact. The papers we signed for the mortgage stated the amount of the mortgage but when Homecomings did their 'AUDIT' it reflected an incorrect amount so they went ahead and changed it without my permission or signature to do so. That took me 6 months of continuous letters and phone calls to fix before the put the mortgage amount back to the amount that it was supposed to be. I am so completely disgusted with this company you would not believe. If anyone is taking part in a class action suit against this company please email me and let me know. I would love to join in and put them out of business.
