Uncooperative, Confrontational, Threatening ripoff

I have to admit, I didn't know this forum was here, but after the phone call I just received, I went straight to the internet to do some searching.

This last year has been difficult, in 2003 I lost my job along with nearly 1500 other employees when the parent company closed down our facility. I was unemployed for nearly 5 months, and with this wonderful economy, the only job I could find was at a 33% reduction in salary.

I had to file bankruptcy to keep my head above water at all, but I reaffirmed my car loan and the two mortgages I had so I could at least have somewhere to live.

Unfortunately, the huge reduction in pay has only created more hardship in trying to make ends meet. Although I am late frequently, my bills are always paid within 30-45 days.

At present, my GreenTree/Conseco mortgage (at an unbelievably high 14% interest rate) is 12 days past its due date, and I've gotten a threatening phone call. I explained my financial hardship and verified my next pay day and said I would send a check so that it could be available then (which would be about 23 days after the first of the month).

The individual who called me said that was unacceptable, and that if I didn't pay now, or authorize a check-by-phone and incur additional charges to pay for that check-by-phone (which I can't afford else be put into an overdraft situation), then it was just too bad, and maybe I should sell my house. He was totally unwilling to work with me other than say, pay now, or eat the additional charges, even though I offered to send a check which would arrive so it could be cashed at the same time as the check-by-phone payment, but without having to suffer the additional charges.

Consequently, he began harrassing me and saying that he would indicate that I was totally unwilling to work with him, and would pursue other action.

Is there anyone who is willing to make a class-action suit, because I'll bet there would be a healthy turn-out for this one.
