Cashed check when promised not to do so before certain date and caused $294 worth of overdraft charges

Dale Elsner showed me a home and I had no intent on buying it, but thought possibly I might. Dale said the trailer was going to be moved to the Valley that weekend and just in case I did want it.

I needed to put a deposit down on it. I told him that I had $0. I also told him that in a week or so that I would be getting quite a few thousand dollars, but not to cash the check until he had spoken with me. He said that it would not be a problem, I just needed to give it to him to show that i had intentions on buying it and they wouldn't have it moved.

The very next day it was cashed! I had $294 worth of bounced check charges alone. Not to include all the frustation I had trying to get money to my bank before I had more overdraft charges. I borrowed money from my Grandmother, Mother and advaced deposits that charged me interest.

I took him to Payson Justice Court for $600 and some odd dollars and the Judge looked at me and said, "Tanya, you are entitled to more than you are asking, but you are sueing the wrong person. You need to sue the owner."
