Bogus Commercial Mortgage Pre-payment Penalty Assessed

Please please help me!!! Chase commercial bank is attempting to steal over a million dollars from my property sale, slated to close escrow monday feb 6!!!

They have presented a completely unfounded payoff figure to chicago title company claiming a pre-payment penalty is due, for which i never signed for or agreed to. And the amount they claim is due has repeatedly increased by more than $113,000 total in eight months! Eight months ago they notified us that it amounted to $512,000. Some months later their pay-off quote stated it was $555,000. Jan. 2012 the pay-off quote they have presented has now increased again to presently $625,000.

They cannot and will not produce any document signed by me to substantiate such excessive amount demanded; therby refusing to release clear title for property on which i am attempting to sell/close escrow feb 6 for $4,630, 000.00.

Chase has repeatedly verbally agreed that such penalty was in error and that chase was in the process of removing this pre-payment penalty! Hence, chase has succeeded in delaying this first and final denial until now, only hours before the sale closing!!!

For the past eight months, i have had attorneys fighting chase on this matter. Chase will not respond to attorney requests for copies of signed documents or any other form of substantiation. Additionallly, they refuse to explain their method of calculation for such trumped-up figures. Now chase refuses any contact with my attorneys stating, that chase deems this a closed matter!!!

This originally was a 6.1% $2,500, 000 wamu a ten year commercial loan. Present principal balance due is approximately $2,300, 000. I have made on-time payments for the past five years. My husband's and my credit scores have always been in the 800's.

I need help from someone!!! I have no place left to turn!!!
