Chapter 13 Filed After Loan Number Changed, Payments Demanded

We had several loans through Citifinancial over the years, starting with Avco, then The Associates, and last but not least Citifinancial. We dealt with Lisa Ferri every time. At the time she seemed like a very nice person, but tell her you have to file for bankruptcy and that changed. We did not have the current loan for very long, and my husband's job fell on hard times and ended up going bankrupt, which in turn sent us down that path.

Per my lawyer, I notified everyone, including Lisa at Citifinancial, but that did not stop the phone calls and nasty messages. Lisa knew we were at our wits' end and called us one day, telling us that they could offer a bit of relief. We asked what that was, and she said that if we came in and signed a few papers, they could give us a month off and our payments would be $15.00 less a month, which under pressure sounded like a blessing.

Sure it was. They managed to assign a different loan number, making it look like we signed for a new loan after the bankruptcy was filed. That makes no sense, since we did not benefit from this new loan, we did not receive any money, no bills were paid, and they even said we called them. I wrote to the BBB, and some guy we never dealt with called me a liar. He said we got the loan after the bankruptcy, when in fact we already had the loan and they just changed the loan number to make it look like we got a different loan. We thought we were going to lose our home but were told we could save it with a Chapter 13, so last June or July we filed Chapter 13. All were notified, and Citifinancial never came forward. We were told by our lawyer that they would not get their money anyway since it is unsecured.

It has been almost 1 year since filing, and on 4-2-04 I received a letter from the courts telling us we now have to pay them their money. Our lawyer said not to sweat this and it will not happen, but how can you not sweat it? These people are nothing but predatory lenders, and how they get away with this is unbelievable! We need to get this stopped. Now I will probably lose my house and they will still get nothing! We just wanted everyone to know what kind of people they are and to please stay away from them!
