Ripoff, fraud or stupidity

My mortgage was part of the large block that EMC bought. I sent the first payment to them in May.in July they began sending me late notices, although I sent a payment every four weeks without fail. I use an online banking system set by me to mail them a check every other payday.

This was a blessing, as it turned out, because it was not just my word against theirs - I had documented evidence from a bank that they were paid on time in addition to my cancelled checks.

I wrote them in July explaining that I was quite irate at the insinuation I had not paid.in October I received a notice of intent to foreclose.

I called several times before speaking with a young lady who politely acknowledged that I should not have received a foreclosure notice. Two days later my mother, who owns the house with me and is well on in years, and I received seperate certified letters with notices of intent to foreclose.

I called again, a little less friendly than the first time. The young lady told me there was a problem entering all the numbers into the computer from the mortgages that had been paid every four weeks instead of once per month. Now I don't know much about Texas, but up north, a payment made every four weeks will never be late if it is due once a month.

On all EMC's correspondence, they tell you all the fees they will charge you for the most minor services. I printed copies of all the cancelled checks along with a log of checks the bank had sent and a letter explaining the situation, specifically that I would not tolerate this foolishness, and sent them a bill for all the copies I had to print from my computer.

EMC does NOT pay their bills. Recently, I sent a letter to them reminding them of their outrageous behavior two years ago, and offering them the oportunity to make amends by cutting my interest rate in half. They turned down that oportunity.

I'm considering borrowing against my retirement fund to pay off the mortgage, lowering my rate to 1/3 what I pay them, and paying them 0% interest. If anyone considers a class action suit against them, I have saved correspondence and will gladly share.
