BOA loan modification gone bad monies misapplied

My husband and I became vivtims of the economy with less income and the fact that we fell behind in our mortage payments. I went through a thrid party call Save my home and they did my loan modification with Bank of America.

In July we were approved for our modification and Bank of America sent us a new agreement with a new loan payment effective 9/1.

I started to make my new payment as instructed and in the agreement they said my account was CURRENT as of 9/1. They applied $15000 to the end of our loan and extended the payoff date for us.

The problem is that they never set my account current they left my arrears at a -$3,800 and considered my new payment that they gave me as a partial payment and began appling two payments as one.

Now they say I am behind because of their record keeping and they are harrassing me and my husband with Foreclosure Notices. I have called countless times spoke to everyone at BOA have written several letters to Mr. Monyihan at BOA, filed two complaints with the OCG and have now reapplied for another modification with BOA and have yet to have gotten an call bank from Eric Castriedia? In BOA home loans.

Not sure what to do next.
