Wells Fargo
Unfair Collection Practices

Business & Finance

The beginning of the year I contacted Wells Fargo, with the current mortgage statement in hand, to bring my account current. The representative for Wells Fargo insisted that I OWED MORE THAN WHAT WAS REFLECTED IN MY MORTGAGE STATEMENT.

Anxious to bring my account current, I paid the additional money only to receive a collection call within approx. 2 weeks advising me that I owed more money. I went ahead and made payment arrangements and asked for an accounting statement to see where my payments were being applied I told them I would not be making any further payments until I received this information.

Of course, I never received an accounting statement and I was technically behind in my payments again. I called Wells Fargo again and was told by the representative that I was on a repayment arrangement and that I had broken that arrangement. I told her that I was offered a re-payment arrangement in late December/early January but never signed the paperwork because I was able to bring the account current.

The representative told me in so many words that she didn't believe me, that re-payment arrangements were never set up at Wells Fargo without signed documents and that I better make good on another repayment arrangement or they would foreclose on my property. Before the representative completed the repayment arrangement, she DISCOVERED FUNDS THAT WERE NOT APPLIED TO MY MORTGAGE and applied those as part of my new payment arrangement. I was one payment from bringing my account current again when I accepted a better job opportunity, which changed when my payments could be made.

I was set up on another repayment arrangement. Shortly thereafter, I had funds stolen from my checking account. Very upset, I called Wells Fargo, advised them of what had happened and entered into another repayment arrangement. Unfortunately, I had called when I was emotionally vulnerable, looked at my calendar and incorrectly identified my pay periods. I called Wells Fargo again and was sent loan re-modification paperwork advising me that I had to have a payment in by 11/10 and the paperwork had to be returned within a short time period. I post dated my check and wrote on it that it would not valid until 11/10. I was confident that the check would not be cashed as it was not sent to a regular payment lockbox and because it was being sent with loan re-modification paperwork.

I received a call advising me that another repayment arrangement would have to be established and that I was not eligible for a loan re-modification. The representative would not address the issues that I had outlined concerning my delinquency and only wanted to discuss my failure to live up to multiple re-payment arrangements.

The next day, I discovered that my CLEARLY POST-DATED CHECK HAD BEEN PRESENTED to my bank and, of course, returned NSF. I contacted Wells Fargo again and in so many words was told that I was an idiot for mailing in a postdated check. I was told that the re-payment arrangement would appear to be broken due to this NSF.

I called Wells Fargo again, spoke with a different representative, and was advised that if I sent my payment as a MONEY ORDER and by certified mail, they would honor the re-payment arrangement. I did exactly as they asked and you won't believe what happened. Wells Fargo applied the payment to my account the day after they received it, they reversed the payment the following day, and then issued a letter to me that the funds they received were NSF! I called Wells Fargo and was advised that the re-payment plan was re-broken and that my account had been red flagged.

I was instructed to call my bank to obtain the status of the money order. I called my bank and they advised that Wells Fargo was paid. Now I have to obtain that paperwork and deal with their representatives again.

In addition to this story, a common them with the representatives at Wells Fargo is multiple phone messages ranging in 3-4 calls per day advising me that I need to return their call. When I return the calls, the representatives ALWAYS tell me that it is not documented on my account that any messages were left for me.

Any assistance in this matter would be appreciated, as now, with accuring interest, my mortgage has become an untamed monster.
