The Law Offices of David Galanter and Justice Paper Processing STOLE our money and gave us NOTHING in return!

Back in the spring we paid the Law Offices of David Galanter (located in New York) $2,495.00 for services to help us with a loan modification. Justice Paper Processing (located in Florida) is the company which the services (or more realisticly... The Lack of sercvices) go through. At that time they assured us that "because" we are in a bankruptcy, and have limited income, we qualified for the HAMP program and that our mortgage company would have to do the mod. We made it very clear that our we had previously attempted to work with our lendor and they would not help us. Through much conversation with their agent Matthew Kline we felt comfortable paying the fee. We did an over the phone application, were told that we qualify, filled out the contract (which they never signed or returned), and sent our money in 3 installments. After about 3 weeks they told us that we did not qualify for the HAMP program then after that they assured us that through legal avenues, our lendor would have to lower our interest rate to somewhere between 2-4%. One day after our last payment was made to The Law Offices of David Galanter we were told by Justice Paper Processing that our lendor would not work with us because we are in a bankruptcy. I was furious and told them to stop all process because we had spent the previous months believing that there were legal ways to force them to help us... This is what we were told. We told them that they would not work with our loan just by asking!

So what did they actually do for $2,495? 1. Lied to us over the phone assuring us that they could help us. 2. They plugged in the numbers we sent off our application, which spit out a report stating that we don't qualify after they already told us we did. 3. They made one phone call to our mortgage company. 4. They kept our money.

Their cancellation policy is extremely vague however it states that we are entitled to a full refund within 3 days of payment. We cancelled within 3 days of our final installment payment, however they want to claim that the policy is from the First payment, but that is not what is says. It does not say from first, second or final payment. We were then told that our refund would be to us in 10 days, then we were told 20 days, then Cory Ende of Justice Paper Processing told us 30 days. We were told by Jonothan Ende of JPP that they would refund 1/3, then it was 50% then 60%. Funny how they change their minds All The Time. My husband spoke to David Galanter who told him that if it was up to him that he wouldn't refund ANY money to us. Hmmmm, the checks were made out to His office, apparently it IS up to him. Either way, it has been months and we still have not received one cent of our money back! I am about to go on a campaign and send a full report to every agency that has anything to do with home loans, media, and consumer agencies. Perhaps the NY Legal Grievence Committee should hear what I have to say also? Yes, I believe so.
