MCM Persistent, Deceptive & Erroneous Debt Collection

First a phonecall in March. Two today, June 3. All advising me of a debt unknown to me.

Putting a stop to those phonecalls per the Fair Dept Collections Practices Act (FDCPA).

Send a letter certified mail with return receipt. The extra step and minimal expense at the post office counter will be more than worth handling phonecalls from debt collectors who are nothing but professional hustlers who spend hours training, manipulating, persuading, harassing and conning consumers.

The letter will give contact information, i.E. Who did I talk to at MCM. Because I got account information, I will include the account number, supposed date of purchase and the supposed account balance.

The letter will be specific in requesting documentation of the debt, also known as debt validation. Debt validation is VITAL. The hustlers can talk all day on the phone about what you may have purchased and what you owe. Sorry, I'm from Missouri through osmosis& gotta show me what you are accusing me of. Show me documentation of the debt.

Will also request how MCM came by the debt collection.

In my specific case I contacted the supposed originator of the debt. They had no proof of the debt and the accounts personnel I spoke with was very helpful in suggesting how to go forward with MCM contact. This letter will state that contact was made with the supposed originator of debt and that there is no proof of debt.

Per the FDCPA, requesting that further communication be done in writing and that any future telephone calls attempting to collect will not be accepted& this will be a statement in my letter.

Going forward, any telephone calls regarding this debt will be responded to with, "I have submitted written correspondence to your organization and have proof of receipt. I prefer any further communication to be in writing." I will thank them for their call and advise that the call is being terminated. Per the FDCPA, MCM cannot phone home before 8 A.M. Or after 9 P.M.

Educate yourself. Even if the debt is not yours, know your state's statute of limitations (SOL). An internet search will enable you to be specific to the current state you live in as well as any other states you may have previously filed an income tax return in.

As tough as it may be, when dealing with these folk in a phonecall, maintain your cool and the upper hand. Don't be buddies, be professional and authoritative. If you can't, use the "written correspondence" line above and terminate the call.

An internet search for Midland Credit Management, aka MCM, is extensive.

Skip the ulcer and handle undue collection harassment per the FDCPA.

If you owe a debt, own up to it. Make payment arrangements.
