Refusal to return engagement fee after over 1 year of not providing funding for a commercial mortgage

My complaint virtually mirrors the previous complaint filed in December by another individual. I provided Infinity Commercial Capital with a $7,500 engagement fee to begin the process of obtaining funding for an Apartment Complex. Contract clearly states the fee is refundable if funding is not obtained.
Back in early April after almost a year of trying to obtain funding and not getting it, I requested the return of my engagement fee since I had complied with all the requests for information asked of me, yet no funding was obtained. I had an initial response from Liz Parks that the company was in the process of re-capitalizing and that it would be about two weeks before they could provide me an answer. When I followed up after the two week period, everything has gone silent. No response to numerous emails to both Tim Curry and Liz Parks.in late April I filed a complaint with the Eastern Michigan BBB, who apparently sent two requests to the company. As of last Friday, May 14th, the BBB advised me that they had not had any response to their requests and were closing the file.
I see where there was one rebuttal to the previous complaint by one of the partners who asserted that they had no files or records of that particular individual, however, I would like to see there rebuttal to this request since I have specifically named the individuals I dealt with.
