I worked for almost twenty (20) years before I was able to purchase a home. It had been my dream for quite some time.

My loan was transferred from Companion Servicing Company to Fairbanks Capital in February. From that point on, I've had nothing but trouble. Payments would not be credited to my account. I started having to send my payments in by certified overnight mail.

Due to the loss of a loved one who helped share expenses,
contingent liabilities and being in a Chapter 13 plan; I
got behind on my mortgage payments. I tried to contact the company and they transferred me all over the place. I finally got someone on the phone and he took some financial information regarding my income and monthly obligations. I heard nothing from them. The next thing that I know, a sheriff came to my door and served me with foreclosure documents.

I then called Fairbanks and found out that my plan had been denied due to excessive monthly obligations. I didn't know that the information was for a plan and the information that he put on the report was incorrect.

I submitted new and correct information and was waiting to hear from them. While waiting and not knowing what to do, I sought the advice of two (2) attorneys and they stated that after the stay was lifted there wasn't anything that I could do but hope that I get in a reasonable plan.

I returned from attending the funeral of a close family member in California on Saturday, October 4. I checked my mail and found a slip to pick up certified mail from the post office.

I picked it up when the post office opened at 8:00 A.M. On this Monday (10-06) morning. When I opened it, I almost went into heart failure. The letter stated that I should sign the documents giving up all rights to sue the company and pay the $1700 down payment by tomorrow, October 7. I then have to make another payment of $945 by October 30. This is a total of $2645 for someone in a Chapter 13 plan and have little
or no disposable income.

My take home pay for the month is only $2,500 per month. I specifically asked in my letter to them asking for help that I did not want to be set up to fail. I have been given 24 hours to have a document signed, notarized and a $1700 payment submitted.
