Excessive use of Overdraft Protectection (assessing fees) Dacula

BOA (Bank of America) uses technology in their favor to assess fees for overdraft. I have OD protection, but each time they deposit $ into my account because they 'feel' that their 'may' be NSFs, it cost me $.

Current situation...

Balance on account - $327.99

Entries on account in order (at no time was their NSF - why the OD Protection?)

12/2 - OD Protection 100.00 = $427.99

12/2 - Withdrawal - 241.32 = $186.67

12/2 - Withdrawal - 26.94 = $159.73

12/2 - Keep the Change -. 06 = $159.67

Activity for 12/3

12/3 - Bill Pay to Retailer (pending) - $94.03

12/3 - Transfer to Account (pending) - $100.00

Why is an OD Protection issued on 12/2 when at no time did the account fall below $0.00??? Because they knew that I had a bill pay scheduled for the following day - really? And because they didn't know that an electronic transfer was going to occur - really???

Current balance because of OD Protection is $165.65

If OD Protection had not occurred - balance would be $65.65.

How can a bank get away with this??? The last time I asked for them to remove the OD deposit, they refused! This has happened at least 3 times to me in the last two months! Multiply that times the number of BOA customers, and this is where they are making their $.

I would change banks... But what a hassle! But I can't keep playing their banking games!

I want some restitution - BAD!!!
