Posts derogratory remarks to everyone's credit with the same name

I pulled a copy of my credit report today and to my surprise there was a negative account from RJM Acquisitons. I had never heard of them before and searching for them on the internet got me nowhere. I finally found a phone number for them on usacomplaints.com and called them.

They couldn't look the account up by the number on my credit report or by my SSN. But they could pull it up by my name. It was an old Fingerhut account from 1997 that I had never had.

They explained it to me like this. RJM is not a Collection Agency, they simply bought all the old debt from Fingerhut and are trying to recover these old debts. (Isn't that by definition exactly what a Collection Agency is? Maybe I am just ignorant) Anyway they asked me if I had made such and such a purchase back in 1997 and i told them no, because I hadn't. Then they go on to explain that these letters (which I never got) were sent to everyone they could research with the same name as me. As they contact RJM and verify the debt is not theirs they cancel them out. Only in my case I never got a letter so I asked them if they posted negative credit on everyone with the same name too (because I found their claim against me on my credit report)

They told me that they do not post anything to the credit agencies, the credit agencies post it. Again I may be ignorant, but who am I supposed to think told Experian to post a claim from RJM.

So what they are doing is sending letters and posting negative credit to anyone with a name that matches up with the one they are looking for. So if they were looking for a Bill Jones, they may have posted negative comments to thousands of credit reports. (Isn't this illegal somehow)
