I am going to begin this with the beginning of where I have had to deal with Weltman, Weinburg, and Reis.

I have been smart up to this time. I have had a third party vender paying my debts with there account number. They have never had my account number in there files.

My account with Weltman was starting to be paid in Feb. It was agreed upon before hand that I would be paying a set amount. From Jan they have been nothing but nasty when communication has taken place.

Even though they had received payment in Feb and Mar they put my account in court in Apr. As far as why this happened, it appears according to all documentation that they received a letter from my employment stating that the interest rate had to be lowered down to 6% accourding to Federal Law under the under Servicemember's Civil Relief Act (SCRA) that was dated April 1. Again, smartly, I have the letter that was sent to them to prove this.

I found out later, that this was considered a payment dispute and should've been referred back to Capital One when this letter was received.instead to keep my account they pushed it through to court. This was one way they broke the law and I have to go through to remove from my credit report.

Now I am to a point I am going to be paying off this debt. I have removed the account through the billing service I have hired and intend to just pay off the account.

I attempted to call ahead 8 days. I told them I am planning on having the money on the 1st of the month to pay off the account. I told them since I had been paying on this account for a year and a half and had already paid so much I wanted to talk about negotiation for on the First of the Month (July 1st). It went through and was negotiated down. Then I was told that they needed my account number, they would push the button on the 30th of the month and then the check would clear later than the 1st. I blantly said no. Then they got as nasty as always when I have had to deal with this company.

This second time was a very gentle breaking the law. Although I would love to say there is guarantees in this world, and that money is never going to be late being deposited in to an account, I can't do it. I was being asked to post date a check (not against the law) and to post date it to a date when I know the money is not available (against the law). I was asked to do this for $2000. If heaven forbid the money won't be there on the first or because they pushed the button and it hit my account on the 30th instead of later, I would have been the one having the banking fees because of insufficient funds and to further that I would've been the one being prosecuted.

Thanks for the advise on documentation. I will make sure I have something in writing before I send them any such payment. I will also make sure they do not get my personal account information to pay this off and will pay them with a casher's check or a couple of money orders. I will have JAG look over anything they write to me and make sure that this debt is being paid off with agreed upon amounts.
