I have not received my 0 refundable deposit of $1500 that I gave them when they said they could modify my loan for me

I hired EQ group to help me with a loan modification back in October. They took the case provided I gave them $1500 and said the deposit was 0 refundable if they didn't achieve the goal of a loan modification. The loan was not modified, my mortgage company rejected the application and since then I have been trying futilely to get my deposit back.
The total cost of their loan modification program is $3000 so I am "lucky" according to some that I didn't give them the whole amount which they had requested but I held out.
Now after many many emails, letters, phone calls and even going to the company in person I am still waiting for my money.
Meanwhile, I am still paying my huge mortgage which is killing me but I don't want to wreck my credit.
