Richard burke of everest asset management is huge on fdcpa violations, abusive behaviour and harrassment

This started all with my mother receiving a phone call from Richard Burke of Everest Asset Management. Richard informed her that if I "did not contact him by the weekend" I "would be in serious trouble".

I called Richard Burke and asked who he was and what his company was & he told me his name and that his company was "Everest Asset Management". I then asked what his company did and his response was "I told you we manage stuff". He would not tell me what his business did until I told him my name.

After I gave him my name his attitude became very rude and then he informed me that he was a collection agent. I told Richard Burke he was to never call my mother again and gave him an updated address telling him that as soon I received the documentation regarding what he was collecting that I would call him back. He told me that he would continue to "bug" my mother. I then asked him for a direct phone for his company, his supervisor's name & phone number which he refused to provide. It was then that I told him that he was to never call me again.

I had to do an internet search to obtain the main phone number to his company called it and spoke to another gentleman regarding my account and told him that I was willing to work with him but I would not work with Richard Burke, due to the abusive behaviour, and that I would be filing a complaint with the FDCPA against him. The gentleman agreed telling me that he would work with me and that he put it in the notes that Richard was to not call me again.

The next afternoon Richard Burke calls proceeds to yell at me and tell me that I "don't get to pick and choose my case manager". I told him to put his supervisor on the phone, he refused and hung up on me. I called back three times and he continued to hang up on me. Two days later Richard Burke calls me again yelling at me, when I said "excuse me" he interupted saying "there is no excuse for you" & hung up. I called back asked to speak with his supervisor when Richard Burke told me that if I called again he was going to file harassment charges on me.

About 15 minutes later I got a phone call from a gentleman named Jack who says he is Richards supervisor. I explained the situation and that Richard had violated the FDCPA in several ways and that I will be filing a complaint against him. I also informed Jack that I would be happy to work with him with the understanding that Richard Burke was to NEVER call me again and that if he did I would immediately file a complaint against the entire company. Jack agreed, apologized for Richard and promised that "unless by accident" Richard would never call me again.

On Sunday 2/8/09 I received 2 phone calls from Richard Burke. I hung up on him the first time and he called back and again while yelling at me told me that I "dont' get to tell him that" he "can't call" and that they "will see me in court". I told him to put Jack on the phone, he refused so I hung up and called Jack myself told him what Richard had said when Jack informed me that they are not intending on taking this to court and that nobody wants to "see this in court". I then informed him that I was filing a complaint against the entire company as well as contacting a lawyer regarding harassment and violations of my consumer rights, which I have done. I am also planning on filing charges against Richard Burke as soon as I can find the right help.
