Manipulates dates to obtain bounce fees

I was aware that a check might bounce, so I was checking my account on line everyday, praying that the check would not be presented before my payroll direct deposit. But it did. Luckily, I printed out copies of my account each day I checked on it.

When I noticed that three items had already cleared my account the previous day but that those same items now appeared with a later date and had been moved to look like they were presented and paid after the check in question, I immediately went to the bank and sat down with the manager.

She gave me some song and dance about how she didn't agree with the bank policy, but the bank can choose what order to process all items presented that day and that it was clearly stated in the booklet I received when I opened my account.

That's when I pulled out my print outs and asked her if the bank also had the authority to actually changed the dates on which items are presented. I told her that my money was to be immediately refunded or I would take my proof of their deception and fraud to the Attourney General and to the Mass. Division of Banks.

With out hesitation she refunded all of my money.

However, they didn't hesitate to charge me $39.00 because I overdrew by. 67 cents about three weeks later. They wouldn't budge on that one.

Needless to say, I immediately cancelled my direct deposit and opened an account with another bank. My account is still in the negative and I will give them $5.00 per week until it is paid off. If they want to take me to court, at least I can show that I am making an effort to clear up my debt.
