Account Service Charge Raises Interest Above Agreed to 4.99%

I just received an "important notice regarding changes to your account" in my credit card statement from Chase. As of January they are adding a "new Account Service Charge of $10 per month" which will be applied to my account. I accepted an offer of a balance transfer loan at in interest rate of 4.99% until the total was paid off. I have never been late paying this loan, have not gone over my limit or done anything to break their rules. The only thing I have done is accept an offer they made to me and kept up my end of the deal.in the notice, it states, "These charges are finance charges and are added to the balance for purchases to your account." These charges then raise my rate above the 4.99% agreed upon rate. They are breaching their contract and should be penalized.
