My situation all started when the mortgage company i was with went out of buisness. My mortgage was bought by Fairbanks Capital Corp. I really did not think to much about it as i understand this happens frequently. O.K. Where do i send my check, no one could tell where my payment should go. A couple of weeks go by i get this letter that my payment is late and needs to be mailed, fine i mailed two months payment to become current and a little ahead.

Thinking every thing is o.K. Several weeks go by and "boom" there is a process server at my door with court papers stating i am being sued for forclosure on my home. Then i get mail from fairbanks returning my check and saying that they would not except my payment that it must be certified funds.

I hired an attourney to fight my case, it went on for about a year fairbanks would not respond to any correspondence, referred me and my lawyer to different offices all over the country would not give out any employee names that we talked to. They offered me a way to rectify the situation $10,000 dollars down and they would refinance the loan (WHAT).

In an effort to refinance the loan fairbanks would not release any paperwok or information in order for me to proceed. Also Fairbanks sent me a letter stating i have no insurance, my agent made many attempts to send them proof of insurance with no avail.

I think that is still unresolved and they continue to charge me for insurance i already have. I was forced to file bankruptcy to save my home which i have about $35000.00 in equity. To this day they still try to screw up account in order to take my home.By the way, my last payment was sent on Dec. 27th 2002 for January 1st payment, it has not been cashed as of January 31st WHATS NEXT.
