How do we SUE these folks?

I guess I should have known when my home loan was purchased by Saxon that there would be continual problems. We've been in our home 14 years with good payment history to our lenders. Once our loan was refinanced, it was sold to Saxon. They did not post our payments for 3 months, assuring us it was a "glitch" and that no negative consumer reporting would be placed on our files. Strike one! They did just that, reported 30,60 and 90 day late payments. Thank you Saxon! We did file disputes with the credit reporting companies, but Saxon refused to respond. That was two years ago. Since, we have had nothing but issues with them.

Most recently, we have been dealing with them since January on payment issues. Last year, my husband was laid off from a very high paying job. We fell behind on the payments, but still paid them. We ran about 2 months behind, only to get continual "intent to forclose" notices.

In January, we discussed a loan modification plan, placing the past due back into the loan and refinancing it. We were given many hoops to jump through, which we did just that. Of course, it took us 4 times to fax the paperwork for them to finally confirm that it had been received. (not unusual as I now understand). We were finally assigned a "loss mitigation workout rep" that would be happy to help us out. Yeah, right. This person forced us into a 3-month repayment plan with a promise that at the end of three months, the loan would then be converted into the modification and we would move forward. The three-month plan was to show "good faith" on our end!???

Well, the three months passed, made the payments as agreed (in addition to the required "down payment" of $2,000 to get the process rolling). At the end of the three months, end of May, we heard nothing. We spent countless hours calling to discuss the plan to no avail. It took until June 11th to have someone determine that what we were told and promised was not going to happen as advised.

So, now here it is August 14, we have once again spent 4 more faxes ($60) total to "re-open" the account for review... in the meantime, they will not accept any partial payments, AND they are issuing FORCLOSURE notices.

We are between a rock and a hard place. We did NOT choose this company. Yes, we initially fell behind due to a job loss, but we've been in constant contact with them, and they are assuring us that all will be fine.

Now, I must say that if I could physically reach through the phone and strangle someone, I would. These are the most ignorant and arrogant folks I have ever dealt with. They have no clue what the left hand is doing.

I don't know where to turn for help. I call HUD, they simply tell me that there isn't anything they can help with, except a homestead exemption. (which, I have no understanding why I would do that?)

I need to find someone to help us. I can't possibly imagine losing our home of 14 years due to the incompetence of Saxon.
