Bait & switch operation. Had a 1yr. Contract and tried to cxl but in tiny print on the back of the 4th page there was a 300.00fee if you didn't give a 90day notice. Never disclosed that information

On Sept. 14th I was approched in my office a sales rep from Electronic Merchant System. A credit card processing company. I was convenced into switching my previous co. To EMS for a few $ savings per month. Being a small business I did. They have their help desk call you and go over limited information. After the training I was ask if I had any questions. I replied no and if I have any problems I would call.

In Dec. I put a charge through for 500.00 and received an authorization. On Jan. 30th I put a charge in for 6200.00. I waited for 7days before I relized the money did not go into my act. Thats when I called and spoke to a very rude supervisor about the transaction and they penalized my act. 155.95 for not batching out in time. I was not aware of any batching out system because of my last Co. That was all automatic and EMS was aware of that when I switch. I was also told that the charge in Dec. For 500.00 never went into my act. They reply to me that I was aware because I said to the trainer if "if I have any problems I would call" so they switch my wording.

So I tried to cxl the contract and was told I would have a 300.00 penaty. I decided to pay the 13.50 per mo. Untill Sep. 2008 to get out of the contract. Today Aug. 13th. I called to make sure all was good w/the cxl. Process and I was told I had to give a 90notice to get that waived and I would have to stay w/them until Sep. 2009 if I gave a notice today. On the front of the contract in bold print it states 300.00 penalty. On the back page of pg. 4 in the tinest print it states the 90 days. It was never brought up to my attention even when I asked back in Jan. 2008.

Please be aware of this company. I ended up giving them the 300.00 to be done w/Electroni Merchant System. I have never written about any co. Before but if I can help protect any business from being a victim of this nature then I have done my job.
