Bank Skipped Summary Judgment Hearing in Foreclosure on My Home

Deutsche Bank called me to court for summary judgment in a foreclosure case on my home.

In my answer, I asked them to make sure they are the registered owners of interest of my home and to file the necessary papers to prove it. They did file a sworn statement that they own the note; however, I did not see its assignment in my papers at all.

Weeks before the court date for summary judgment, I called my lawyer to take the case.

On the day in question, the bank did not attend the court date to defend the foreclosure they started.

I have a feeling they are having trouble with the paperwork and did not send a lawyer so as not to lose the case, and/or be barred from coming to court without proper documents.

My loan is upside down as the market value dropped so quickly.
