Calls From A.R.M. For someone that 'UseTo' have my current Phone Numbe

In Aug. 2008 I moved & recieved my current Phone number. The old holder of this number had run up some debt. Many creditors have called asking for her. All but one has stopped calling once I told them I am not her, & that company was Accounts Receivable Management. When they first started calling I explained as I have to others I don't know the woman in question & I had recently received this number & to please take me off thier call list. When they called back a few days later I again repeated the statement. They told me they will keep calling untill she paid her debts.in fact thier calls have become more frequent, now daily & sometimes 2 x a day. I contacted my lawyer who told me to follow these steps; 1. Document all calls, time & date. 2. Call your Phone provider & report the harassment. 3. Contact your state Attorney General office, the F.T. C, the Better Bussiness Bureau & if you are registered, the National Do Not Call Registry & report them. 4. Then send them a Certified letter explaining you want contact to your phone # to end (making sure the number is listed in the letter as well as your name, address & the date), that the calls are harassment. Tell them they are violating Public Laws 95-109 and 99-361, also known as the Fair Debt Collection Practices Act, If you are on the DO Not Call Registry tell them they are violating the D.N.C.R. Act as well. They will say they are not a telemarketer so they aren't bound by the D.N. C list. Tell them, "The FTC told me although the law is aimed at Telemarketers, it holds true for any company who hasn't had a relationship with me due to the fact the calls aren't solicited, which makes the calls, de facto Telemarketing calls." Then go on to tell them, "your organization must CEASE & DESIST all calls to (type in yuor number). Failure to comply will result in my filing a yet another complaint with the Federal Trade Commission and the Ohio Attorney General's office". Then tell them, "Let this letter also warn you that I will utilize telephone recording devices in order to document any telephone conversations that we may have in the future.

Furthermore further harassment will cause me to file a suit against you, both personally and corporately, to seek any and all legal remedies available to me by law. I will pursue all criminal and civil claims against you and your company. I 'm aware your company has had many Federal, State & civil lawsuits against it, for violating the Fair Debt Practices Law. I don't see why you would invite yet another lawsuit for harassment". Close the letter, "I simply request remedy to the ongoing harassment I have endured. Give this matter the attention it deserves and have a nice day". Then type in your name & sign it. Address it to: Joe Burch, Sr. V.P. Accounts Receivable Management, Inc. 155 Mid Atlantic Parkway. THOROFARE, NJ 08086 Keep your Certified Mail Reciept as you will need it later. Even if you are the debtor you can still send a letter asking them to cease calling you and if they dont you report them again to your state A.G. & the F.T.C. & you then can sue in Civil Court. If they refuse your letter & it's returned to you, you can move forward.
