Settlement agreements never sent and attempts or have withdrawn money before there is an agreement

First, this company represents Bank of America and other companies such as Unifund. I tried settling a debt with a Fred Hanna Associate collector, however the total is still is question. They go by Mr and Mrs. And last name. I gave them a bank account with the stipulation that if we have an agreement I need it in writing prior to withdrawals to settle my acct. At first they stated they can fax it, then I guess only a supervisor can fax it. Then they said they sent a letter. I sent them a letter saying that they are not authorized to withdraw funds without an agreement. I called their office two days before and a day before saying I did not get a letter and was passed around. Despite the letter that states they are not authorized to take my money, they attempted to. They put it through five days later even though I sent a letter stating that settlement letter was not received. (They could have faxed it but said they could not only a supervisor could) They did not call until the money was not there.

Sometime later I received what appears to be a backdated letter or late sent letter that arrived 10 days later without the actual specific details of the settlement. When I spoke with them in good faith explaining that they need this in writing they started to threaten me with court because the funds should have been there per our agreement yet that was only if I got the settlement letter. Obviously, I figured them out. They try to take your money and pretend there is no agreement. The guy even told me the letters mean nothing anyways.

They pass you from one collector to another and they spoke to me so rude saying pay your bill, you didn't have funds in your account. They even pretend you are arguing with them when you are just asking questions. Why would you put money in there if they don't have a settlement agreement with you? And the guy said well if you won't send me money now (again no agreement in writing an old letter does no good) then I am done speaking with you and he hung up on me. Sounds unreal? I can't believe it. It's like the other blogs about them. I was more shocked so I called him back and said I want to settle this and he wanted the money tomorrow. Well we are back to the letter!!! He wants money without the letter.

So how do you settle? Really I don't think there is any way to settle with this company without having an attorney. Do not enter into anything without proof of a settlement, do not tell them your acct number, if so call your bank and get a new acct.

Bottom line is there are options.

BEWARE!!! Record everything. This company is only out to separate you and your money. Any help will be appreciated.
