Sls ripoff unfair billing and payment practices

This is regarding our loan servicing account with Specialized Loan Servicing in Littleton, CO (our payments are sent to PO Box, in Atlanta, GA).

HOW is it legal for this mortgage SERVICER to have an admittedly UNWRITTEN and PREVIOUSLY UNDISCLOSED policy of not applying partial payments to a consumers principal balance due? Not only have they done this, but they ALSO held onto the payment and categorized it as "unapplied funds" all the while reporting the payment as unreceived and LATE to the credit bureaus, thereby severely compromising me and my spouse's credit rating.

We have been in contact with the Better Business Bureau, all three credit bureaus AND the State of Colorado Department of Law. We are ready to sue in a court of law if necessary.

WE ARE UP TO DATE on ALL of our payments due to SLS as it relates to the BALANCE DUE ON THE MORTGAGE. The outstanding balance they keep focusing on is SOLELY late fees and other misc. Fees assessed by SLS. They HAVE NOT cleared up the misleading information given to me by their customer care rep in September as it related to when late fees and negative credit reporting. She SPECIFICALLY told me 60 days for both. WHY were we charge for being between 1 and 45 days late? WHY is there a "rolling" 30-day late note on our credit reports? Basically, it's the SAME 30-day late from December that they are rolling forward month after month, DESPITE being paid ALL of the MORTGAGE money due to them (not including late/misc. Fees).

On Friday, June 1, there was an UNDATED, UNSIGNED notice left in an envelope at our front door from some undetermined entity on behalf of SLS stating: "At the request of Specialized Loan Servicing, An independent Field Inspector called on you today — despite SLS's claim that they did so once before in October WITHOUT our knowledge — for which we were charged a $8.40 fee. June 1 was the FIRST time we EVER received such a notice regarding same.

We complained to the BBB, FTC AND the Colorado Department of Law. If you've been ripped off, do the same and go a step further by CONTACTING THESE PEOPLE TO COMPLAIN ABOUT THEIR SHADY BUSINESS practices:
