Issues credit card to incompetent, permits fraud, then threatens lawsuit

My 81-year-old mother has been mentally incompetent since at least 1979. Nonetheless, MBNA issued her a VISA card by mail. After my father died in 1997, fraud artists began targeting my mother. A Caribbean-based company charged nearly $8,000 against her card in three months and a mail-order jewelry company in Ohio nailed her 14 times in that same period for nearly $3,000.

We did not discover either the card or these charges until we put my mother in a nursing home. We contacted MBNA and explained the situation. MBNA could have charged these claims back against the businesses, but they did not do so.

MBNA has hired Jerold Kaplan Law Office, P.C., of Phoenix, AZ, to sue my mother for the fraudulent charges plus the accrued interest, now a little over $19,000. My mother is in a nursing home for Alzheimer's patients and could not possibly either defend herself or assist in her defense. (As of this posting, I do know if a lawsuit has actually been filed.) Kaplan identifies its client as Creditrust Corporation; I do not know what the relationship is between Creditrust and MBNA.
