Ripoff Confiscated house payment and then reports late to credit breaus

We refinianced our home in May of 05, in December of 05 our loan was sold for the 3rd time to America's Servicing Company. We have always had an impound account set up for our property taxes and home owner's imsurance.

In January of 06 we received a past due property tax bills, we immediately got on the phone and starting contacting ASC, (America's Servicing Company). We talked to them almost weekly until in May when we received a letter from them saying that we had an impound account set up, and everything was current.

In July of 06 we received a past due bill from ASC for the impound account. We talked to them several times and in July and early August, finally determined that our payment did not include enough money to fund the impound account, that an impound account had not be set up from the beginning. We acknoledged that we owed the money and since it was a substantial amount, over 10K we made a payment schedule and paid off by October of 06.

Between August and October we were in constant contact with ASC, we kept calling and asking why were we continuing to receive letters and phone calls daily threatening to foreclose on our house even though we have over 50% equity in our house? A Supervisor admitted that the left had did not know what the right was doing. They sent me a letter where I had to request that the collections part of the company stop harrassing us.

It got so bad that my teenage daughter asked me if we were going to loose our house.in October the impound had been paid and our statement still showed a negative balance. I called ASC again and talked to a Supervisor and she told me they wanted the impound account to be funded in advance, to igrore this negative number.

In January of 07 I get notified by my credit service that I have received a unfavorable report. I checked it out and found out that ASC has reported that my house payment is late to the credit breaus.

I contact ASC in late January and talk to two different supervisors and ask what is happening? The second supervisor tells me that ASC took my August house payment and applied towards the impound account. I say I was never told of this and how can they do that? He did not have an answer. He kept on yelling at me that ASC had paid my deliquent property taxes and I shoud be thankful.

At this time I say I do not want to have an impound account with ASC, he says now that we have had a problem we have to have an impound account for at least another year. How can you do that, he says it is a ASC rule. He also tells me it has to be funded a year in advance. I say that is extortion, he says it is the rule.

I finally give in, how much do I need to send in for the impound account for a year, he tells me exactly what to send. We send in the amount he specified plus the house payment.instead of doing what he said he paid the amount they determined was due on the impound account and pay the house payment a month in advance. ASC then changed me late fee's and admin fee's even though the house payment was a month in advance.

In February I found out that ASC has 5 call centers across the country. That maybe this would explain why no one ever calls you back, each time you talk to a different person, each time there is a different answer, no one takes responsibility or cares.
