Zombie Collector, Sues 1 month after buying my old debt

My ex wife and I took out a 3 year loan from Beneficial to pay for her fathers funeral services back in March of 99' We paid back the loan monthly ontime until our seperation and divorce in April of 01'. Neither of us made any payments or correspondance on this loan thereafter. Beneficial racked up interest on the loan to an until it reached an amount of $4,813 and then charged the loan off. Neither of us heard anything on this for 5 years and 7 months until my ex wife was served court papers Nov.

It says she is being sued by Midland Credit Management for $4,800 with an additional $5,000 in interest and attourney fee's of $1,500 for a total amount of $11,300 plus court costs. I filed a dispute with the credit reporting agencies back in March of 06' regarding Statute of limitations and it was erased from my credit report. However it appears now that Midland bought the loan in July of 06' and filed it on my wifes Credit report in September of 06' as an individual account. They changed the status date to Dec 01' changing the statutes of limitations. They did not file this on my report. Now they are suing her in County Court.

My ex wife has never heard a word or recieved a letter or a phone call from Midland Credit Management until she was served Court Papers. How can a collection company buy a loan and then sue 2 months later for all of this money without even notifying the consumer that they bought the debt. This is not my problem since they did not even bother to file against me or file on my credit report but I do not want to see my son's mother get thrown under the bus. The statutes of limitations is up in 4 1/2 months. The court date is quickly approaching. Can anyone offer some advice?
