Fraudulent late payments / stealing insurance checks

I am a single mother, just divorced. Every single cent that I received from a 17 yr abusive relationship is in my house. And believe me... Money from an abusive man over a period of 17 yrs is like "blood money". I had a great mortgage company to begin with. I could call and ask anything that I wanted and they would always help and answer my questions. I never had a late payment and always paid my bills in plenty of time. They sold my mortgage to ASC and I never knew it.

I got my first late payment the first month because I sent the payment to my old mortgage company. Next thing I knew, ASC was calling threatening and demanding payment in full or they were going to forclose on my house in a couple of weeks if the payment wasn't received. I thought it was a joke at first because I had never heard of them and knew they weren't my mortgage company.

I then called my mortgage company who said that they did indeed sell it and explained to me that was normal and regular procedure and that the new one was supposed to contact me. I had to call ASC which was a pain because no one there knew their head from a hole in the ground and no one could tell me where to send my payment or how much. I never got a straight answer so called back the next day.

They switched me from person to person and put me on hold which took up the entire morning. I still never got answers. I cried and cried and became scared to death and called everyone I knew for help to see what I was supposed to do. Finally I got a notice from ASC in the mail demanding payment withint a couple of days PLUS a late fee. Then a call every night.

In that letter it gave an address so I sent the payment along with the next months payment. Wouldn't you know, the second payment never got posted. They claimed that they never received it even though it was in the same envelope. So I got another late payment added. I finally got straightened out the 3rd month (getting a payment notice). I sent it in on the first and I have until the 14th before it is actually considered late. THat is the way that I had always done it before and I never had a late payment. Payment after payment, was never posted until the 16th.

Forget trying to call ASC and talking to them. No one knows where to transfer you IF you even get to speak with a human. Finally I sent the payment in on the 16th for the payment due on the 16th of the following month (a whole month early). I know the mail doesn't take an entire month from TENN to IOWA (where the payment was going.) That is when I finally realized that something fishy was going on.

By then, my credit was already ruined because of them. It had dropped nearly 200 points. I talked to an attorney who told me to pay on line. I called and they said that they do not do that and they are not set up for that and they couldn't take payments on line, that my only choice was mailing payments.

So I continued for a couple of months by mail which I always received a late charge because they never posted until the 16th no matter when it was sent. I was a single female and had no idea what to do until I began to look for somewhere else to live because month after month I continued to be harrassed for no payments that I really made.

I put the house up for sale and in the mean time someone told me to set the on line payments through my bank whether ASC has on line banking or not. So I did. Now they have to post it on time because my bank guaranteed payment on a certain date.

I guess that made them mad because while my house was up for sale a hail storm came through Tenn and damaged my house really bad.insurance said $15,000 worth. I couldn't sell the house while it was tore up. I hired someone to fix it and the first insurance check was $8,000. I spent that fixing most of it plus $5,000 out of pocket (which was my house payment reserve money. I used that because I knew that I would get the rest of the insurance money as soon as it was mostly fixed. Well the insurance gave me the check and I sent it to ASC to sign it and they wouldn't sign it.

I spent my house payment reserve to pay for the house and now ASC won't give me my money so I can't fix the rest of the house nor pay the payment now. They want things that are totally rediculous and I sware if I sent them some of my blood it wouldn't be good enough. They want to keep the check and the rest that is left over and they want to send someone from Iowa to inspect after it is fixed. Then they want to be the ones that pay the repair person (s), however if they want to be that involved and responsible then they should be the one to do the hiring too but NO... They don't want that part. They are just trying to get their hands on the money part and keep what is left from the check they keep. Is that right? I have never had to deal with an insurance company but to me, that sounds like a rip off to me.

You would think that a mortgage company would want the house fixed. Why does this company not want it fixed and why do they just want the check? Why even have insurance if I can't get it fixed. So at this point, I am about to lose my house because of ASC and the bad thing about it is that I think that it is a scam and they are trying to make it where I do lose it so they can sell it and make a profit.

The thing about it is that if they don't quit their little scams, they are going to put 3 little kids and a mother of an abusive relationship on the streets. (I am beginning to wonder if God enjoys playing these sick jokes on me and watching me live in chaos and hell.) ASC is making getting my insurance money totally impossible to get.

At this point, I have moved out, living with a friend and I have no idea what to do. I have children and no way to make the money that a man can unless I go to school. And being harrassed constantly by this company for their fault... Not mine is not making it easy to study in order to get out and have a good job where I can support my children.

I got into this house after my divorce and had it fixed that I would be able to make it for a while until I got out of school and could work and make money to support myself and my children. Now ASC is ripping me off.

If there is anybody out there that knows of something... Anything that I can do, please help me. When are they going to take out a class act law suit on them. Will they just hurry. I can't afford an attorney. I am afraid that I will lose my house by next month. I can't get another loan in order to get rid of these stupid people because they have ruined my credit with their scam. It is on my credit report and no one will let me refinance it.

I have tried just to get rid of them but I didn't realize what was going on early enough. I was so nieve that I didn't realize that there were people out there that got their kicks out of watching others squirm. Help! Plealse!!!
