Shady Practices To Get More Money From Fees ripoff

Our mortgage was purchased by ASC from Centex Home Equity last year. They had taken over our mortgage and was servicing it before we were ever even notified which caused 2 months of payments to "disappear" because we sent them to Centex as always. ASC was calling us about payments being past due but we had no clue who they were or why because to our knowledge our mortgage was with Centex. And of course the reps we talked to didn't believe us. Treated us like liars and thieves.

Finally we got the letter dated 2 months prior though the postmark was dated 3 days from receipt of the letter. We were able to figure out the problem and get the money to the right people but were charged fees for late payments. We didn't feel responsible for those fees but ASC disagreed. They didn't want to hear anything we had we to say. We could never get the same rep on the phone and the new rep we spoke to had no idea what we were talking about because there were no "notes in the system".

Now our biggest problem is once again fees! Our mortgage payment is sent out by our online banking account on time (as documented by the bank) but somehow every month ends up being processed by ASC after the due date. Therefore late fees are being charged every month. Last month I spoke to a rep at ASC almost 3 weeks after the payment was sent who told me my payment had been received 4 days after the bank sent it but had not been processed or applied to my account yet therefore incurring a late fee. Why should I pay that fee? It was sent, you received it, you sat on it, not my fault. ASC did not agree they said I'd have to pay it to stay in good standing.

If interest rates were better I'd refinance just to get away from ASC!
