Returned Check Error and Home Visits Over Home Equity Loan

Business & Finance

I took out a home equity loan from this company back in January of this year (06). When the office called for payment on the loan, I authorized my checking account to be debited to keep my account with Citifinancial current. I have always paid check by phone and always with the same lady. Then I got a call from Citifinancial that my check was returned as insufficient funds. I knew that wasn't right, so I immediately went to my bank to see what the problem was. My bank informed me that there was no record of a check from Citifinancial trying to clear on my account. That means one thing: the information was not entered correctly, and this is the same account that we have always drafted on. I realize that we are all human and make mistakes, but don't tell your boss, and please don't tell me that the check was returned as insufficient.

That really didn't upset me until Citifinancial started coming to my house, sometimes twice a day, wanting money. I did not do another check by phone to replace the one that Citifinancial says was insufficient. I had taxes that I had to pay for my grandparents, and that took everything from that account, so I could not do anything until I received my settlement check. I told Citifinancial that if the numbers had been entered correctly the first time, I would have budgeted better for my grandparents' taxes. I was threatened with foreclosure, I got phone calls every day and visits to my home, and this is the one thing that pushed me to the edge.

I have a radio tower on another portion of my property that I receive a lease check from monthly. A lady that works at Citifinancial called the company from whom I receive that monthly check and told them that they needed to move their tower equipment off of the property because Citifinancial is in the process of foreclosing on that property. I received a letter in the mail from the company that has the tower on my property, stating that Citifinancial had called them trying to get in touch with me and that I should call them because they were concerned about the situation. I therefore called the tower company and spoke with a gentleman, and he stated that the lady with Citifinancial informed him that they would be foreclosing on the property, so they needed to remove their tower equipment.

I was so mad that I called Citifinancial and spoke to the lady who called this company and told them to remove their equipment. I asked her why she did that, and she said it was because they could not get in touch with me. But keep in mind that they have been coming to my house and speaking to me, so they have been in contact with me. I also informed the lady at Citifinancial that where this tower is located is 1 mile away from the home on which the loan was taken out. Our city code says you cannot have a home anywhere near a tower. It has to be the height of the tower times 3 feet away, in case it happens to fall. The lady replied, "Well, I don't know where it is located, because I have never been out to look, and until I do so, that is where I stand." I said to her, do you not think that you have violated my privacy?
